Terms of Use
These Terms govern your access to and use of Moja, a digital business card service operated by Vanguard BI.
Effective date: June 30, 2026
1. Agreement to These Terms
By accessing or using Moja, creating an account, publishing a card, scanning a QR code, downloading a vCard, submitting a form, or using any related feature, you agree to these Terms of Use ("Terms"). If you do not agree, do not use Moja.
These Terms form an agreement between you and Vanguard BI ("Vanguard BI", "Moja", "we", "us", or "our"). If you use Moja on behalf of an organisation, you represent that you are authorised to bind that organisation, and "you" includes that organisation.
2. The Service
Moja lets users create, publish, update, share, and delete digital business cards. A card may be shared through a web link, QR code, or downloadable contact file. Moja may also include onboarding emails, view counts, lead forms, support, and related Vanguard BI business services.
Moja is designed for professional networking and contact sharing. It is not intended for storing confidential records, regulated sensitive information, emergency communications, identity documents, financial records, health data, or information you are not allowed to share.
3. Eligibility and Accounts
You must be able to enter into a legally binding agreement under the laws that apply to you. If you are using Moja for an organisation, you must have authority to do so.
- You must provide accurate account and card information.
- You are responsible for activity under your account.
- You must keep your sign-in method, devices, and email account secure.
- You must tell us promptly if you believe your account has been compromised.
- We may refuse, suspend, or terminate accounts that violate these Terms or create legal, security, or operational risk.
4. Card Limit
Unless we agree otherwise in writing, each user may create up to three cards. We may enforce this limit through account controls, Firestore records, or other technical measures.
We may offer team, managed, custom, or paid arrangements with different card limits or features. Those arrangements may be subject to additional terms.
5. Your Card Content
You are responsible for all information, images, links, names, phone numbers, email addresses, logos, company details, and other content you add to a card or submit through Moja ("Your Content").
You represent and warrant that:
- Your Content is accurate and not misleading;
- you have the rights, permissions, and lawful basis needed to publish Your Content;
- Your Content does not infringe intellectual property, privacy, publicity, data protection, confidentiality, or other rights;
- Your Content does not include unlawful, harmful, discriminatory, defamatory, deceptive, abusive, or malicious material;
- you will not publish personal data about another person unless you have a lawful basis and any required permission to do so.
6. Public Sharing, QR Codes, and Deletion
A published card is meant to be shared. Anyone with the card link, QR code, or a forwarded copy may view the card and may save, download, copy, screenshot, print, or redistribute the information outside Moja.
You may download your card QR code and place it on physical business cards, banners, posters, brochures, booths, slides, email signatures, or other materials. You are responsible for making sure the printed or displayed QR code is accurate, scannable, lawful, and suitable for the context.
If you delete a card, its Moja link and associated QR code stop working. Deleting a card does not remove copies already saved by other people, downloaded to their devices, cached, printed, screenshotted, or shared outside Moja.
7. Acceptable Use
You must not use Moja to:
- violate any law, regulation, court order, or third-party right;
- impersonate a person or organisation, misrepresent your role, or create deceptive cards;
- publish someone else's personal data without authority;
- send spam, phishing, malware, fraudulent messages, or deceptive links;
- harass, threaten, abuse, defame, discriminate against, or harm others;
- upload malicious code, attempt unauthorised access, probe systems, scrape at scale, or interfere with service operation;
- circumvent authentication, card limits, rate limits, security controls, or usage restrictions;
- reverse engineer or copy the service except where allowed by law;
- use Moja to collect personal data from others in a way that violates applicable data protection or marketing laws;
- use the service for high-risk, emergency, life-safety, or regulated uses for which Moja was not designed.
8. Data Protection Responsibilities
Our Privacy Policy explains how we process personal data. By using Moja, you agree that we may process personal data as described in that Policy.
If you upload, publish, or otherwise provide personal data about another person, you are responsible for complying with the data protection laws that apply to you. This may include the GDPR, Kenya's Data Protection Act, South Africa's POPIA, direct marketing rules, employment privacy rules, and similar laws.
If you use Moja as an organisation, you are responsible for giving your staff, contractors, or representatives appropriate privacy notices and for ensuring that you have a lawful basis for the card details you instruct us to process.
9. Intellectual Property
Moja, including its software, design, layout, trademarks, branding, text, icons, code, and service structure, is owned by Vanguard BI or its licensors and is protected by intellectual property laws.
Subject to these Terms, we give you a limited, revocable, non-exclusive, non-transferable licence to use Moja for its intended purpose. We do not transfer ownership of Moja to you.
You retain ownership of Your Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, transmit, format, modify for technical purposes, and otherwise process Your Content as needed to provide, secure, improve, and support Moja.
If you send us suggestions or feedback, you allow us to use them without restriction or compensation.
10. Third-Party Services
Moja depends on third-party services such as hosting, authentication, database, storage, analytics, email delivery, CRM, mapping, browser, phone, email, and messaging tools. Third-party services may be subject to their own terms and privacy policies.
We are not responsible for third-party services, their content, their availability, or the way they process data, except where applicable law makes us responsible for processors acting on our behalf.
11. Vanguard BI Services
Moja may invite you to contact Vanguard BI about services such as Google Workspace, professional email, cloud, analytics, automation, team cards, design, or printed business cards. Those services may be subject to separate proposals, order forms, service terms, partner terms, pricing, and payment obligations.
Information on Moja about third-party products, such as Google Workspace, is provided for general information and may change. Any third-party product is governed by that third party's terms.
12. Fees
The standard Moja card builder may be offered free of charge. We may introduce paid plans, premium features, team offerings, managed services, printing, or other paid services in the future. We will tell you about applicable fees before charging you.
13. Availability and Changes
We aim to keep Moja useful and available, but we do not guarantee uninterrupted, error-free, or permanent availability. We may update, suspend, restrict, remove, or discontinue parts of Moja at any time, including for maintenance, security, legal compliance, abuse prevention, or business reasons.
We may change features, design, limits, storage methods, links, domains, or integrations. We will try to avoid unnecessary disruption, but you are responsible for keeping backup copies of important contact information and printed material.
14. Suspension and Termination
You may stop using Moja at any time. You can delete cards where the product gives you that option. You may contact us for account or privacy requests.
We may suspend or terminate your access, remove content, disable links, or take other action if we reasonably believe:
- you breached these Terms;
- your use creates legal, privacy, security, reputational, or operational risk;
- your content is unlawful, misleading, harmful, infringing, or abusive;
- we are required to do so by law, regulator, court order, or competent authority;
- the service, feature, or account arrangement is discontinued.
Sections that by their nature should survive termination will survive, including intellectual property, privacy, disclaimers, limitation of liability, indemnity, governing law, and dispute provisions.
15. Disclaimers
Moja is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, representations, and conditions, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and security.
We do not guarantee that a QR code will scan in every environment, that every device will handle vCards in the same way, that every viewer will save your contact correctly, or that printed materials will remain accurate after you change or delete a card.
Nothing in these Terms limits rights or warranties that cannot be excluded under applicable consumer, data protection, or other mandatory law.
16. Limitation of Liability
To the maximum extent permitted by law, Vanguard BI and its directors, employees, contractors, affiliates, suppliers, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, business opportunity, reputation, or anticipated savings, even if we have been advised of the possibility of such damages.
To the maximum extent permitted by law, our total aggregate liability for claims arising out of or relating to Moja or these Terms will be limited to the greater of the amount you paid us for Moja in the three months before the claim arose or KES 10,000.
These limits do not exclude or limit liability that cannot be excluded or limited under applicable law, such as liability for fraud, intentional misconduct, or certain data protection obligations.
17. Indemnity
To the extent permitted by law, you agree to indemnify and hold Vanguard BI harmless from claims, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising from:
- Your Content;
- your use or misuse of Moja;
- your breach of these Terms;
- your violation of law or third-party rights;
- your publication or sharing of personal data without proper authority.
18. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify users, such as by updating the effective date, posting a notice, or sending an email. Continued use of Moja after updated Terms take effect means you accept the updated Terms.
19. Governing Law and Disputes
These Terms are governed by the laws of Kenya, unless mandatory law in your location requires otherwise. The courts of Kenya will have jurisdiction over disputes arising from or relating to these Terms or Moja, subject to any mandatory consumer, data protection, or other rights you may have in your country.
Before starting formal proceedings, please contact us so we can try to resolve the issue in good faith.
20. General Terms
- These Terms and the Privacy Policy are the entire agreement between you and us for your use of Moja, unless a separate written agreement applies.
- If any part of these Terms is found unenforceable, the rest remains in effect.
- Our failure to enforce a term is not a waiver of that term.
- You may not assign your rights or obligations under these Terms without our consent. We may assign these Terms as part of a business transfer, restructuring, or operation of the service.
- Headings are for convenience only and do not affect interpretation.
